Terms and Conditions

1. Scope and Contracting Party

These Terms and Conditions (T&C) apply to all contracts regarding the maintenance, repair, and construction of musical instruments between Bashkirixa GmbH (Share capital 10,000 €, Managing Director Julia Leitner, Jakominiplatz 14, 8010 Graz) and its clients. These terms are supplemented by the provisions of the Austrian Consumer Protection Act (KSchG) and the Distance and Off-Premises Contracts Act (FAGG).

2. Scope of Services and Ordering

An order is deemed placed upon the handover of the instrument or through a written agreement. The initial diagnostic check is performed free of charge (0 €). Before starting any actual work, a detailed cost estimate and specification are created and coordinated with the client. The services provided are those described in the specific service offerings available on our website.

3. Prices, Taxes, and Payment Terms

All prices listed on the website include the statutory Value Added Tax (VAT) of 20%. Billing is based on actual effort or a fixed price as per the agreement. For business clients (B2B), a payment period of 30 days from the invoice date applies. Private individuals are required to settle the amount upon collection of the instrument.

4. Appointments, Cancellation, and Changes

Appointments are provided as guidelines. Changes to work already in progress must be agreed upon in writing. In the event of a cancellation after work has commenced, the hours incurred up to that point will be billed. Completed instruments are stored free of charge for a period of 14 days; thereafter, a storage fee may be applied.

5. Acceptance, Warranty, and Liability

We provide a warranty of 6 months on the performed work. This warranty refers exclusively to the professional execution of the service, not to the general condition of the instrument or wear-and-tear parts. Liability for damages during storage is limited to the insured value. The intellectual property rights to the result (e.g., individual construction plans) remain with Bashkirixa GmbH unless otherwise agreed.

6. Special Provisions (CITES)

We do not perform work on instruments or parts made from protected species (e.g., ivory, Brazilian rosewood) unless valid CITES documentation is provided. The presentation of these documents is a prerequisite for the acceptance of such instruments.

7. Consumer Protection and Final Provisions

Consumers are entitled to the statutory right of withdrawal according to the FAGG, provided the contract was concluded outside of business premises. The exercise of the right of withdrawal is excluded if the service has already been fully performed. In case of disputes, the competent court is located in Graz.
